लगातार दूसरी बार विधानसभा चुनाव में जीत दर्ज कर सत्ता में आई भाजपा की प्रदेश सरकार ने लगभग दो महीने बाद उत्तराखंड में समान नागरिक संहिता लागू करने की दिशा में बड़ी पहल कर दी है। विधानसभा चुनाव के समय किए गए समान नागरिक संहिता लागू करने के वायदे को धरातल पर उतारने के लिए प्रदेश की भाजपा सरकार ने विशेषज्ञ समिति का गठन कर साफ संदेश दे दिया है कि वह इस विषय को लेकर गंभीर है। धामी सरकार के इस कदम को प्रदेश ही नहीं, बल्कि देश की राजनीति के दृष्टिकोण से भी अत्यंत महत्वपूर्ण समझा जा रहा है।
मार्च में संपन्न विधानसभा चुनाव से पहले मुख्यमंत्री पुष्कर सिंह धामी ने घोषणा की थी कि भाजपा के फिर सत्ता में आने पर उत्तराखंड में समान नागरिक संहिता लागू की जाएगी। उत्तराखंड में समान नागरिक संहिता को लेकर विमर्श काफी पहले से चल रहा है। वर्ष 2017 में जब भाजपा तीन-चौथाई बहुमत के साथ सत्ता में आई, उसके बाद बुद्धिजीवियों ने इसकी संभावना पर गंभीरता से विचार शुरू किया। इसका कारण यह माना गया कि देवभूमि उत्तराखंड की प्रकृति को यह कानूनी प्रविधान काफी कुछ संरक्षित रखने में महत्वपूर्ण भूमिका निभा सकता है। धीरे-धीरे यह विमर्श राजनीतिक मुद्दा बन गया।
इस बीच केंद्र सरकार के स्तर पर समान नागरिक संहिता लागू किए जाने की बात उठने पर उत्तराखंड में यह मुद्दा हाशिये पर चला गया। लगभग चार महीने पहले विधानसभा चुनाव के समय जब मुख्यमंत्री धामी ने समान नागरिक संहिता लागू करने की अपनी मंशा प्रदर्शित की, तब कांग्रेस की ओर से यह कहकर उपहास किया गया कि यह तो केंद्र का विषय है और प्रदेश सरकार इसमें हस्तक्षेप कर ही नहीं सकती। कांग्रेस नेताओं ने यहां तक कटाक्ष करने में देरी नहीं की कि भाजपा को संवैधानिक प्रक्रिया का ज्ञान नहीं है।
यद्यपि, मुख्यमंत्री की चुनाव से पहले की गई घोषणा पर विधि विशेषज्ञों ने अध्ययन के बाद यह राय दी कि समान नागरिक संहिता के कुछ प्रविधान प्रदेश सरकार के स्तर पर भी निर्धारित किए जा सकते हैं। इससे भाजपा का मनोबल बढ़ा। इसका परिणाम यह हुआ कि विधानसभा चुनाव में दो-तिहाई सीटें जीत कर भाजपा ने जब सत्ता में दोबारा वापसी की तो पार्टी ने साफ कर दिया कि सरकार जल्द इस दिशा में कदम उठाएगी। दूसरी बार मुख्यमंत्री पद की शपथ लेने के तत्काल बाद पुष्कर सिंह धामी की अध्यक्षता में पहली ही कैबिनेट बैठक में प्रदेश में समान नागरिक संहिता लागू करने की प्रतिबद्धता प्रदर्शित करते हुए समान नागरिक संहिता का ड्राफ्ट तैयार करने के लिए विशेषज्ञ समिति बनाने के प्रस्ताव पर मुहर लगा दी गई।
कैबिनेट की स्वीकृति के लगभग दो महीने बाद अब सरकार ने उच्चतम न्यायालय की सेवानिवृत्त न्यायाधीश की अध्यक्षता में विशेषज्ञ समिति गठित कर दी। महत्वपूर्ण यह कि इन दिनों मुख्यमंत्री पुष्कर सिंह धामी स्वयं चम्पावत विधानसभा उप चुनाव के रण में ताल ठोक रहे हैं। इस दृष्टिकोण से भी सरकार के इस निर्णय के कई निहितार्थ निकाले जा रहे हैं। उत्तराखंड की भाजपा सरकार ने समान नागरिक संहिता लागू करने की दिशा में कदम बढ़ा दिए हैं, तो निकट भविष्य में अन्य भाजपा शासित राज्य भी इसका अनुसरण करते दिख सकते हैं।
